These Terms of Service govern your use of TradeReply AI's automated SMS lead-capture service. By texting a business that uses TradeReply AI, or by engaging TradeReply AI as a Contractor, you agree to these Terms.
1. Description of Service
TradeReply AI provides an automated text-messaging assistant that responds on behalf of service-business Contractors — HVAC, plumbing, electrical, painting, and similar trades — when a call is missed. The assistant collects basic information: name, service needed, location, and preferred callback time, and forwards it to the Contractor.
The assistant does not diagnose problems, provide pricing, make promises, or act as a representative empowered to bind the Contractor to any agreement.
2. SMS Consent and Opt-Out
By sending a text message to a phone number operated by TradeReply AI on behalf of a Contractor, you consent to receive automated text messages related to your inquiry. Message frequency depends on your conversation. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for support.
3. No Guarantee of Service Outcome
TradeReply AI facilitates communication between you and the Contractor. We do not guarantee that the Contractor will respond, accept the job, or honor any specific price, timeline, or availability. All service arrangements are solely between you and the Contractor.
4. Contractor Responsibilities
Contractors using TradeReply AI are responsible for:
- Responding to leads in a timely and professional manner
- Ensuring their own business practices comply with applicable law
- Any statements, pricing, or commitments made after the lead is handed off
5. Acceptable Use
You agree not to use the Service to transmit unlawful, abusive, or fraudulent content, or to attempt to interfere with the normal operation of the Service.
6. Limitation of Liability
TradeReply AI is provided "as is." To the fullest extent permitted by law, TradeReply AI and its operators are not liable for any indirect, incidental, or consequential damages arising from use of the Service, including missed leads, delayed responses, or inaccuracies in information relayed between parties.
7. Changes to the Service or Terms
We may modify or discontinue the Service, or update these Terms, at any time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
8. Governing Law
These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles.
